Lease with Option to Purchase Contracts Approved for Manufactured Housing Communities - November 9, 2016

Jodie McDougal, Senior Shareholder, Construction and Real Estate Attorney, and Chair of the Construction Department, as well as other attorneys at the Davis Brown Law Firm including Emily Stork, advocated to the Iowa Banking Superintendent for approval for manufactured housing communities to use Lease with Option to Purchase contracts.

 

These contracts allow for the sale and lease of mobile homes without having to comply with the requirements of the Dodd Frank Act, the SAFE Act, and other laws regarding residential home financing.  Previously, an option for the sale of homes was not available to landlords and owners of manufactured homes unless they complied with all such laws and obtained the necessary state and federal licenses, and buyers and sellers needed to work through a mortgage loan originator which adds costs and prevents some individuals from buying.

 

Through their efforts, Davis Brown attorneys gained approval for this Lease with Option to Purchase method without the need for compliance with such residential home financing laws.
