Legal Issues Impacting Your Business
New HIPAA Regulations Regarding Breach Notifications
The American Recovery & Reinvestment Act of 2009 (“ARRA”) modified HIPAA by requiring covered entities to notify individuals if their unsecured protected health information is breached. On August 24, 2009, the Department of Health & Human Services (“HHS”) issued interim regulations implementing these statutory provisions. Compliance with the new regulations is required by September 23, 2009. The following is a summary of the new requirements as well as action items that need to be completed by September 23, 2009.
