Q: I heard that Work Comp changed the rules about positive drug tests in work comp claims - is that true?
A: It is accurate that in 2017 the Iowa Legislature amended the Workers’ Compensation Law to make it clearer that being under the influence of drugs or alcohol at the time you sustained an injury could result in the employee being ineligible to receive workers compensation benefits. However, that law did not change the Iowa Drug Testing Statute, Iowa Code 730.5, and the employer is still required to follow all of the statutory requirements in order to obtain a drug test which could be used in any legal proceeding or to defend a termination of employment.
