Iowa Utilities Board and Dakota Access Pipeline Update - February 22, 2016

For the past few months, the Iowa Utilities Board has been considering the Dakota Access pipeline case.  Among other things, at issue is whether Dakota Access should be considered a utility and whether the IUB otherwise has authority to grant eminent domain powers to Dakota Access allowing the company to forcibly access Iowa private farmlands for the proposed pipeline. 


Davis Brown senior shareholder, Bill Hanigan, has represented a number of landowners in the case and recently filed a Post-Hearing Brief and a Reply Brief with the IUB.


The IUB will reconvene in open session on March 9, 2016 at 9am to review the draft order and discuss any changes necessary and release a final decision on March 9 or 10.
